Welcome to the Privacy Policy (the “Policy”) of the Military Officers Association of America and its two subsidiary charities, the MOAA Scholarship Fund and The MOAA Foundation (collectively “MOAA,” “we,” “us,” and “our”). When we refer to “you” or “your” in this Policy we mean any individual who interacts with or uses our Services.
The purpose of this Policy is to inform you how we collect, use, and share your Personal Information (defined below) when you provide it to us or when you use MOAA’s website available at www.moaa.org (“Website”), together with all other related MOAA webpages, products, services, programs, requests, or content accessible through any means (collectively the “Services”).
By using the Services, you represent that you understand and agree to this Policy, and consent to the collection, use, and sharing of your Personal Information as described in it. If you do not consent to our practices, you can choose not to use the Services. You may still engage with MOAA through our Mission Support Center by using the contact information at the end of this Policy.

I. PERSONAL INFORMATION WE COLLECT
MOAA collects information that is linked or reasonably linkable to an identified or identifiable individual (“Personal Information”). MOAA also collects non-Personal Information that cannot be linked or associated with any individual person. When non-Personal Information is combined with other information so that it does identify an individual person, we treat that combination as Personal Information. We may collect, use, store or transfer different kinds of Personal Information about you to provide you with services or products. We have grouped these together as follows:
Identifiers such as your first name, middle name, last name, alias, username or similar unique personal identifier, account name, social security number, online identifier, military biographical background information, MOAA membership information, date of birth and/or gender.
Contact Information such as your billing address, residential or business address, email address and telephone numbers.
Financial Information such as credit or debit card information, bank account information, payment details, or other payment information.
Profile Data such as username, password, preferences and social media account identifiers.
Commercial and Activity Information such as details about the MOAA’s membership benefits and/or resources you have acquired; MOAA events such as elections, council or chapter events, webinars, seminars, or workshops you have registered for or participated in; and magazine subscriptions you have registered for, products you have purchased in MOAA’s store and/or marketplace, funds, grants or other financial assistance recipient information, donations you have made, and/or other details of Services you have acquired from us in the past, general inquiries, comments, feedback, and survey responses.
Internet and Other Electronic Network Activity Information such as cookies, internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our Services.
Usage Data includes all information about how you use, process, and interact with our Services. Some examples of this include statistics regarding the opening and clicking on emails sent by MOAA and activity on the Website, such as pages viewed, product and service offerings seen.
Marketing and Communications Information such as marketing campaign data, click-throughs, date/time stamps, your preferences and consent in receiving marketing from us and third parties, email, text and chat communications, and your communication preferences.
Audio and Visual Information such as call recordings and videos.
Inference Data includes inferences drawn from the Personal Information identified above.
A. If You Do Not Provide Personal Information.
Where we need to collect Personal Information by law, or under the terms of a contract we have with you, and you do not provide that data when requested, we may not be able to perform the contract we have or are trying to enter with you (for example, to provide you with products or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.
B. Information You Provide to a Third Party.
The Services may include links or plug-ins to websites operated by third parties, including social media sites, such as Facebook, Twitter, Instagram, YouTube, LinkedIn, Reddit and Pinterest, as well as links to websites, including but not limited to, third-party vendors, affinity partners, and affiliated MOAA Councils and Chapters (“Third-Party Sites”). MOAA does not control any Third-Party Sites and is not responsible for any information they may collect. The information collection practices of a Third-Party Site are governed by its privacy policy. It is your choice to enter any Third-Party Site. We recommend that you read its privacy policy if you choose to do so. Setting your preferences regarding particular types of communications you receive from MOAA will not impact communications you receive from third parties. You will have to set your preferences with the third party.
C. Children’s Online Privacy.
The Services are intended for adult use only and are not directed towards children, minors, or anyone under the age of 18. If you are under the age of 13, you are not authorized to provide us with any Personal Information. If the parent or guardian of a child under 13 believes that the child has provided us with any Personal Information, the parent or guardian of that child should contact us at msc@moaa.org to have this Personal Information deleted from and/or anonymized within our systems and files, to the extent technically feasible.
II. HOW WE COLLECT YOUR PERSONAL INFORMATION
A. Information You Provide to Us
MOAA may collect Personal Information from you that you voluntarily provide to us in various ways, including, but not limited to, when you:
Join MOAA’s life membership, premium membership, or basic membership, and manage your account with us.
Subscribe to, register for, or purchase any of MOAA’s membership benefits or resources.
Place an order or purchase products in MOAA’s store and/or marketplace.
Call, email, text, chat or otherwise communicate with us.
Register for or participate in MOAA events such as elections, council or chapter events, webinars, seminars. or workshops.
Sign up to receive MOAA’s newsletters, publications, reports, or the Military Officer magazine.
Respond to surveys, marketing emails, or on-line advertisements; participate in promotions or use the site or e-mail recommendation features.
Write or post a review of, or critique concerning, MOAA.
Submit an Education Assistance Program Application, Crisis Relief Program Application, and/or other applications for MOAA’s programs, such as, the Crisis Relief Grant and Community Outreach Grant Application.
Donate to MOAA or any of the MOAA charities.

B. Information We Collect When You Use Our Services
1. Automated Technologies or Interactions.
As is true of most websites, we receive and store certain types of Personal Information whenever you interact with us online. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, click-through data, and/or clickstream data. When you access and use our Services from your mobile devices, we receive data from that mobile device. This may include your device ID, location data, IP address and device type. You may manage how your mobile device and mobile browser share location information with us, as well as how your mobile browser handles cookies and related technologies by adjusting your mobile device privacy and security settings. Please refer to instructions provided by your mobile service provider or the manufacturer of your device to learn how to adjust your settings.
2. Cookies and Tracking Technologies.
We and our service providers use cookies, pixels, and other tracking technology to recognize your browser or device and to capture and remember certain information about your activities on our Services. For example, cookies gather information about how long you spend on a web page so that we can understand what web pages are of interest to users. If you prefer, you can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off cookies by adjusting your browser settings. If you turn off your cookies, some of the features of the Website may not function properly. Pixel tags generally work in conjunction with cookies, registering when a particular device visits a particular page. You cannot decline pixel tags; however, if you turn off cookies the pixel tag will simply detect an anonymous visit. In addition, we use pixel tags in our HTML-based emails to let us know which emails have been opened by the recipients. This allows us to assess the effectiveness of certain communications and our marketing campaigns. If you prefer not to be tracked through our emails, most email services will allow you to turn off pixels by disabling external images in settings.
C. Information We Collect from Third Parties
We collect Personal Information from various third parties, including but not limited to those listed below. The collection, use, and disclosure of Personal Information received from third parties is governed by the privacy policies listed on the website where the information was submitted by the user. Third parties may send their own cookies and pixel tags to you and may collect information and use it in a way inconsistent with this Policy. Please carefully review these third-party privacy policies to understand how these third parties may collect, use, and disclose your information.
1. Third Party Service Providers.
We collect Personal Information from service providers, such as payment processors, analytics, fulfillment centers, shipping providers, e-commerce platforms, website hosts, e-mail service providers, and marketing and advertising providers, etc.
2. Third Party Advertising Partners.
We collect Personal Information received from third party advertising partners, such as partners who host and manage various online advertisements and ad platforms, etc. This may be combined with the website analytics data described below.
3. Google Universal Analytics (“Google Analytics”).
We use third party cookies provided by Google Analytics to assist us in better understanding our website visitors. These cookies collect IP address and usage data, such as the length of time a user spends on a page, the pages a user visits, and the websites a user visits before and after visiting our website. Based on this information, Google Analytics compiles data about website traffic and interactions by assigning a randomly generated number as a user identifier, which we use to offer better user experiences and tools in the future. You can also opt out of advertising cookies using the Google Ad Settings.
D. Your ‘Do Not Track’ Browser Setting.
Some web browsers incorporate a Do Not Track (“DNT”) feature that signals to the websites you visit that you do not want to have your online activity tracked. Currently, our website does not recognize or respond to DNT signals. Other third-party websites may also keep track of your browsing activities when they provide you with content, which enables them to customize what they present to you on their websites. We may allow certain third-party advertising partners to place tracking technology, such as cookies and pixels on our Services. This technology allows us and/or third parties to collect Personal Information about your online activities over time and across different websites. Doing so allows us to assess the efficacy of our marketing efforts, the value of our product offerings, and enhance your overall user experience.
III. HOW WE USE YOUR PERSONAL INFORMATION
A. Purposes for Which We Will Use Your Personal Information
Our primary purpose in collecting Personal Information is to provide you with an efficient and customized experience for the products and services you have purchased, ordered, requested, or otherwise receive. We may also use or share your Personal Information for any lawful purpose, including, but not limited to, the following:
To assist you with creating and managing your membership account with us.
To communicate with you regarding MOAA-related topics, such as your current or prospective membership, and matters regarding your relationship with MOAA.
To provide MOAA chapters in your geographic area, career field, or special interest a way to contact you regarding MOAA-chapter-related topics, such as your current or prospective membership.
To solicit, collect, and process payments and/or donations, and complete transactions.
To provide the products, services, and customer support available to members or that you request or purchase.
To verify your identity and account information in connection with products or services you request.
To provide you with our publications, such as electronic newsletters and the Military Officer magazine.
To operate our Education Assistance and Crisis Relief Programs and provide information to you about our programs’ activities.
To resolve disputes.
To troubleshoot problems and provide support.
To enforce any Terms of Use associated with our Services or this Policy.
To customize, measure, personalize, develop, and improve our products, services and content.
To inform you about products, services, updates, memberships, benefits, and promotional offers from us, MOAA charities, MOAA affiliated councils and chapters, our third-party vendors, and our branding, advertising, business and affinity partners.
To provide you with recommendations for products, services, memberships, and benefits from us, MOAA charities, MOAA affiliated councils and chapters, our third-party vendors, and branding, advertising, business, and affinity partners that we believe would be of interest to you.
To customize the advertising and content you see.
To manage and market MOAA events such as elections, chapter events, webinars, seminars, or workshops
To protect our interests, including establishing, exercising, and defending legal rights and claims.
To enroll you in a Basic MOAA Membership at no charge to you, contingent on your eligibility.
As necessary, to comply with legal requirements, to prevent fraud, to co-operate with law enforcement and regulatory authorities, and to stop other prohibited, illegal, or harmful activities.
For purposes disclosed at the time we request, or you provide, your Personal Information as otherwise set forth in this Policy.
To perform or advance the mission of MOAA and the MOAA charities.
IV. HOW WE DISCLOSE YOUR PERSONAL INFORMATION
We disclose your Personal Information to third parties for the purposes described above, as follows: (Note: information disclosed to third parties becomes governed by that third party’s privacy policy and practices, pursuant to the terms of a data use and protection agreement, or other restrictions, if any.)

You may direct us or be presented with an option to have us send certain information to third parties or give them access to it.
B. User Disclosures.
Some Personal Information is disclosed as a matter of course because of your use of our Services. Please note that any Personal Information shared via any public forum on our Services will become public information.
C. Third Parties.
We may disclose your Personal Information to our service providers; subsidiary charities; independent affiliated councils and chapters; licensees, vendors, branding, advertising, business, and affinity partners; successors, assigns; and others who may use your Personal Information for the purposes described above.

V. COMMUNICATIONS AND OPTING OUT
By establishing an account, becoming a member of MOAA, subscribing to any of MOAA’s membership benefits, making a purchase, registering to attend any event or to receive MOAA’s electronic newsletter or the Military Officer magazine, or otherwise providing identifying or contact information, you may receive periodic commercial/promotional email communications from us, such as special MOAA programs, offers, and benefits. If eligible, you may also receive free Basic MOAA Membership. You may express your preference to opt-out of receiving such promotional or offered membership communications at any time by following the unsubscribe instructions in a promotional email or by emailing msc@moaa.org. This opt-out will not apply to transactional, operational or informational emails related to your account and purchases. You may continue to receive promotional messages for a short period while we process your request. You may change your preferences to begin receiving types of communications again through our manage preferences links at the bottom of emails.
VI. HOW WE PROTECT YOUR PERSONAL INFORMATION
While we endeavour to incorporate reasonable safeguards to help protect and secure your Personal Information such as transmitting information via industry standard secure server layer (SSL) and tokenized payment processing, no data transmission over the Internet, mobile networks, wireless transmission or electronic storage of information can be guaranteed to be 100% secure. Therefore, we cannot guarantee its absolute security. It may be possible for third parties to intercept or access transmissions or private communications unlawfully. Any such transmission is done at your own risk.
VII. ABILITY TO ACCESS, UPDATE AND CORRECT PERSONAL INFORMATION
MOAA wants your Personal Information to be complete and accurate. You represent and warrant that all information you provide will be complete and accurate, and that you will update that information as necessary to maintain its completeness and accuracy. To confirm the completeness and accuracy of, or make changes to, your Personal Information, please contact us at msc@moaa.org or by changing the profile settings on your account.
VIII. STATE PRIVACY RIGHTS
Depending on your jurisdiction of residence, you may have certain rights with respect to your Personal Information. This section describes your potential privacy rights and explains how to exercise them.
Right of Access. You have the right to confirm whether we are processing your Personal Information and to access such Personal Information we process. You may exercise this right not more than two times per calendar year.
Right to Correct. You have the right to correct inaccurate Personal Information that we maintain about you, though we may need to verify the accuracy of the new data you provide to us.
Right to Delete. You have the right to request that we delete Personal Information that we collected about you under certain circumstances. Please note that some information may not be eligible for deletion based upon applicable law or requirements of contracts. If we delete your information, we may not be able to provide certain products or services to you.
Right to Portability. You have the right, to the extent the data is available in a digital format, to obtain a copy of your Personal Information in a portable, and to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance. You may exercise this right not more than two times per calendar year.
Right to Opt-Out. You have the right to opt out of processing Personal Information for the purposes of: (i) targeted advertising, (ii) the sale or sharing of Personal Information, or (iii) profiling in furtherance of a decision that produces a legal or similarly significant effect. MOAA does not engage in profiling or the sale of Personal Information as a direct exchange. MOAA does share information as described in this policy in ways that may be considered a sale in certain jurisdictions.
Right to Withdraw Consent: You have the right to withdraw your consent at any time where we are relying on consent to process your Personal Information. If you withdraw your consent, we may not be able to provide certain products or services to you.
Right to Non-Discrimination: We will not discriminate against you in any legally prohibited manner for exercising any of your privacy rights.
Right to Appeal. You have the right to appeal any decision that includes a refusal to act on a request. If applicable, you can file an appeal by responding to the email with our decision or by contacting us at msc@moaa.org, within fifteen (15) calendar days. We shall inform you in writing of any action taken or not taken, with the reasons for the decision, in response to an appeal within sixty (60) days of its receipt. If we deny an appeal, we shall provide you with an online mechanism, if available, or another method through which you may contact your state’s Attorney General to submit a complaint.
California Privacy Rights. California residents have the right to receive information that identifies any third-party companies or individuals that MOAA has shared your Personal Information within the previous calendar year, as well as a description of the categories of Personal Information disclosed to that third party. You may obtain this information once a year and free of charge by contacting us at msc@moaa.org or writing to us at the address below.
IX. EXERCISING YOUR PRIVACY RIGHTS
Requests to know, correct, or delete can be submitted by calling our toll-free number +1 (800) 234-6622, or by contacting us at msc@moaa.org. You can opt-out of having your Personal Information shared with third parties for targeted marketing by adjusting the settings on your internet browser, by unsubscribing from commercial communications, or by managing your communications preferences. In most circumstances, you can enable and disable cookies from websites under Privacy and/or Security in the Settings function of your browser. Additionally, if your browser supports it, you can turn on the Global Privacy Control (GPC) to opt-out of the sharing of your Personal Information for targeted online advertising. You can learn more about the GPC and how to enable it in your browser from the Global Privacy Control website.
Please be aware that, unless otherwise noted, the rights specified in the “State Property Rights” section above currently apply only to Nebraska consumers. We will update this policy if we learn of their applicability in other jurisdictions. Only you or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information.
A. Authorizing an Agent to Act on Your Behalf
When using an authorized agent, you must provide that person with written permission clearly describing their authority to make a request on your behalf. That agent must also be able to verify their identity with us and provide us with their authority to act on your behalf. An individual to whom you have provided Power of Attorney pursuant to applicable state rules may also make a request on your behalf. We may deny a request from an authorized agent if the agent does not provide us with the signed written permission demonstrating that they have been authorized to act on your behalf, among other justified reasons.
B. Verifying Your Request
The verifiable consumer request initiated by you or your authorized agent must:
Include your full legal name, email address, phone number, and any system IDs and membership or account information we will need to contact you and to verify that you are the person about whom we collected Personal Information or an authorized representative.
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
If you are making the request as an authorized agent, you must also provide the full legal name of the party for which you are making the request and documentation upon which your authorization is based.
We cannot respond to your request or provide you with your Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. One of our representatives will contact you to verify your identity. You may need to provide additional information to verify your request. We will only use this Personal Information to verify the identity of the person or authorized representative making the request.
C. Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. The response we provide will also explain the reasons we cannot comply with a request and provide instructions on how to appeal to the Attorney General as described above, if applicable.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
X. CHANGES TO THIS POLICY
We reserve the right to modify this Policy at any time without notice. All changes are effective immediately upon posting. Your continued use of the Services after changes are posted constitutes your acknowledgement of the modified privacy policy and agreement to abide and be bound by that privacy policy. For reference, the effective date of this Policy is posted at the bottom of this page. Therefore, we encourage you to periodically check this page for changes made to this Policy or you can contact us at any time to obtain the latest copy of this Policy.
