Privacy Policy

Welcome to the Privacy Policy (the “Policy”) of the Military Officers Association of America and its two subsidiary charities, the MOAA Scholarship Fund and The MOAA Foundation (collectively “MOAA,” “we,” “us,” and “our”). When we refer to “you” or “your” in this Policy we mean any individual who interacts with or uses our Services.

The purpose of this Policy is to inform you how we collect, use, and share your Personal Information (defined below) when you provide it to us or when you use MOAA’s website available at www.moaa.org (“Website”), together with all other related MOAA webpages, products, services, programs, requests, or content accessible through any means (collectively the “Services”).

By using the Services, you represent that you understand and agree to this Policy, and consent to the collection, use, and sharing of your Personal Information as described in it. If you do not consent to our practices, you can choose not to use the Services. You may still engage with MOAA through our Mission Support Center by using the contact information at the end of this Policy.

In this Policy, you will find descriptions of the following items:

 

 

I.  PERSONAL INFORMATION WE COLLECT

 

MOAA collects information that is linked or reasonably linkable to an identified or identifiable individual (“Personal Information”). MOAA also collects non-Personal Information that cannot be linked or associated with any individual person. When non-Personal Information is combined with other information so that it does identify an individual person, we treat that combination as Personal Information. We may collect, use, store or transfer different kinds of Personal Information about you to provide you with services or products. We have grouped these together as follows:

 

A.  If You Do Not Provide Personal Information.

Where we need to collect Personal Information by law, or under the terms of a contract we have with you, and you do not provide that data when requested, we may not be able to perform the contract we have or are trying to enter with you (for example, to provide you with products or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.

 

B.  Information You Provide to a Third Party.

The Services may include links or plug-ins to websites operated by third parties, including social media sites, such as Facebook, Twitter, Instagram, YouTube, LinkedIn, Reddit and Pinterest, as well as links to websites, including but not limited to, third-party vendors, affinity partners, and affiliated MOAA Councils and Chapters (“Third-Party Sites”). MOAA does not control any Third-Party Sites and is not responsible for any information they may collect. The information collection practices of a Third-Party Site are governed by its privacy policy. It is your choice to enter any Third-Party Site. We recommend that you read its privacy policy if you choose to do so. Setting your preferences regarding particular types of communications you receive from MOAA will not impact communications you receive from third parties. You will have to set your preferences with the third party.

 

C.  Children’s Online Privacy.

The Services are intended for adult use only and are not directed towards children, minors, or anyone under the age of 18. If you are under the age of 13, you are not authorized to provide us with any Personal Information. If the parent or guardian of a child under 13 believes that the child has provided us with any Personal Information, the parent or guardian of that child should contact us at msc@moaa.org to have this Personal Information deleted from and/or anonymized within our systems and files, to the extent technically feasible.

 

 

II.  HOW WE COLLECT YOUR PERSONAL INFORMATION

 

A.  Information You Provide to Us

MOAA may collect Personal Information from you that you voluntarily provide to us in various ways, including, but not limited to, when you:

 

B.  Information We Collect When You Use Our Services

 

1.  Automated Technologies or Interactions.

As is true of most websites, we receive and store certain types of Personal Information whenever you interact with us online. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, click-through data, and/or clickstream data. When you access and use our Services from your mobile devices, we receive data from that mobile device. This may include your device ID, location data, IP address and device type. You may manage how your mobile device and mobile browser share location information with us, as well as how your mobile browser handles cookies and related technologies by adjusting your mobile device privacy and security settings. Please refer to instructions provided by your mobile service provider or the manufacturer of your device to learn how to adjust your settings.

 

2.  Cookies and Tracking Technologies.

We and our service providers use cookies, pixels, and other tracking technology to recognize your browser or device and to capture and remember certain information about your activities on our Services. For example, cookies gather information about how long you spend on a web page so that we can understand what web pages are of interest to users. If you prefer, you can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off cookies by adjusting your browser settings. If you turn off your cookies, some of the features of the Website may not function properly. Pixel tags generally work in conjunction with cookies, registering when a particular device visits a particular page. You cannot decline pixel tags; however, if you turn off cookies the pixel tag will simply detect an anonymous visit. In addition, we use pixel tags in our HTML-based emails to let us know which emails have been opened by the recipients. This allows us to assess the effectiveness of certain communications and our marketing campaigns. If you prefer not to be tracked through our emails, most email services will allow you to turn off pixels by disabling external images in settings.

 

C.  Information We Collect from Third Parties

We collect Personal Information from various third parties, including but not limited to those listed below. The collection, use, and disclosure of Personal Information received from third parties is governed by the privacy policies listed on the website where the information was submitted by the user. Third parties may send their own cookies and pixel tags to you and may collect information and use it in a way inconsistent with this Policy. Please carefully review these third-party privacy policies to understand how these third parties may collect, use, and disclose your information.

1.  Third Party Service Providers.

We collect Personal Information from service providers, such as payment processors, analytics, fulfillment centers, shipping providers, e-commerce platforms, website hosts, e-mail service providers, and marketing and advertising providers, etc.

 

2.  Third Party Advertising Partners.

We collect Personal Information received from third party advertising partners, such as partners who host and manage various online advertisements and ad platforms, etc. This may be combined with the website analytics data described below. 

 

3.  Google Universal Analytics (“Google Analytics”).

We use third party cookies provided by Google Analytics to assist us in better understanding our website visitors. These cookies collect IP address and usage data, such as the length of time a user spends on a page, the pages a user visits, and the websites a user visits before and after visiting our website. Based on this information, Google Analytics compiles data about website traffic and interactions by assigning a randomly generated number as a user identifier, which we use to offer better user experiences and tools in the future. D.  Your ‘Do Not Track’ Browser Setting.

Some web browsers incorporate a Do Not Track (“DNT”) feature that signals to the websites you visit that you do not want to have your online activity tracked. Currently, our website does not recognize or respond to DNT signals. Other third-party websites may also keep track of your browsing activities when they provide you with content, which enables them to customize what they present to you on their websites. We may allow certain third-party advertising partners to place tracking technology, such as cookies and pixels on our Services. This technology allows us and/or third parties to collect Personal Information about your online activities over time and across different websites. Doing so allows us to assess the efficacy of our marketing efforts, the value of our product offerings, and enhance your overall user experience.

 

 

III.  HOW WE USE YOUR PERSONAL INFORMATION

 

A.  Purposes for Which We Will Use Your Personal Information

Our primary purpose in collecting Personal Information is to provide you with an efficient and customized experience for the products and services you have purchased, ordered, requested, or otherwise receive.  We may also use or share your Personal Information for any lawful purpose, including, but not limited to, the following:

We disclose your Personal Information to third parties for the purposes described above, as follows: (Note: information disclosed to third parties becomes governed by that third party’s privacy policy and practices, pursuant to the terms of a data use and protection agreement, or other restrictions, if any.)

 

A.  Information You Instruct Us to Disclose.

You may direct us or be presented with an option to have us send certain information to third parties or give them access to it. 

 

B.  User Disclosures.

Some Personal Information is disclosed as a matter of course because of your use of our Services. Please note that any Personal Information shared via any public forum on our Services will become public information. 

 

C.  Third Parties.

We may disclose your Personal Information to our service providers; subsidiary charities; independent affiliated councils and chapters; licensees, vendors, branding, advertising, business, and affinity partners; successors, assigns; and others who may use your Personal Information for the purposes described above.

Categories of Personal Information that have been and will be disclosed to third parties:

1.  Service Providers.
We use third-party service providers to perform certain business services and disclose Personal Information to such service providers as needed for them to perform these business services. Service providers are only allowed to use, disclose, or retain the Personal Information to provide these services and are prohibited from selling your Personal Information. Business services provided may include, but are not limited to, hosting services, e-commerce services, communications and e-mail provider services, website development services, billing, accounting and payment processing services, fulfillment and shipping services, compliance services, analytics services, survey services, customer and technical support services, and advertising/marketing and promotional services.
 
We use Google’s reCAPTCHA tool to protect our website from various types of abusive processing attempts. For this tool to work, reCAPTCHA analyzes various information that it collects from each visitor, which may include the IP address, cursor movements, length of stay, and other information gathered by Google. By using reCAPTCHA, this data is sent to Google and used to determine whether the visitor is a natural person or an abusive automated program (e.g. bot). You can find more information about reCAPTCHA at https://www.google.com/recaptcha. All information captured by the Google reCAPTCHA tool is subject to Google’s Terms and Privacy Policy.
 
2.  Subsidiary Charities.
We disclose Personal Information to our subsidiary charities, who may use your Personal Information for the purposes described above, such as to solicit, collect, and process payments and/or donations, and complete transactions, and to operate their programs to include transition assistance, education and outreach, crisis relief, grant programs, educational assistance and scholarship programs, and other charitable purposes. Though the charities are wholly owned subsidiaries, we include them here for completeness.
 
3.  Officially Chartered Independent Affiliates. 
We share Personal Information with our officially chartered, independent affiliate councils and chapters who may use this information to provide you with information about programs, activities, and memberships within communication guidelines we establish for them. MOAA and the MOAA-chartered councils and chapters share common purposes and support one another, however, the councils and chapters are separate legal entities and operate independently from MOAA.
 
4.  Third Parties Business Partners.
We share Personal Information with licensees, vendors, branding, advertising, business, and affinity partners for the purposes described above, such as to customize, measure, personalize, develop, and improve our products, services and content; provide you with recommendations and inform you about products, services, updates, memberships, benefits, and promotional offers from our third-party vendors, branding, advertising, business, and affinity partners; and to customize the advertising and content you see.
 
5.  Mergers and Acquisitions.
We do business with third parties to whom we may choose to sell, transfer, or merge parts of our operations, business, or assets. Alternatively, we may seek to acquire other operations, businesses, or assets or to merge with them. If a change happens to our operations, business, or assets then the new operators, owners, successors, or assigns may use your Personal Information in the same way as set out in this Policy.
 
D.  Legal Process.
Subject to applicable law, we may disclose information about you (i) if we are required to do so by law, regulation or legal process, such as a subpoena; (ii) in response to requests by government entities, such as law enforcement authorities; (iii) when we believe disclosure is necessary or appropriate to prevent physical, financial or other harm, injury or loss; or (iv) in connection with an investigation of suspected or actual unlawful activity.
 E.  Personal Information Sold or Shared for Targeted Advertising.
We provide Personal Information with our third-party advertising and business partners to serve ads to you about our or their products and services as you browse the Internet (aka targeted advertising). This may meet the broad definition of “sale” or “sharing” in some jurisdictions. In these situations, the use of the information we share is limited by policies, contracts, or similar restrictions. These third-party advertising and business partners may use their own cookies or tags to track your online activities and purchases to deliver targeted advertising based on your interests. Additionally, if your browser supports it, you can turn on the Global Privacy Control (GPC) to explore opting out of the “sharing” of your Personal Information. Learn more about GPC through this link. MOAA has no actual knowledge of any sale or sharing of Personal Information of minors under 16 years of age.

 

V.  COMMUNICATIONS AND OPTING OUT

By establishing an account, becoming a member of MOAA, subscribing to any of MOAA’s membership benefits, making a purchase, registering to attend any event or to receive MOAA’s electronic newsletter or the Military Officer magazine, or otherwise providing identifying or contact information, you may receive periodic commercial/promotional email communications from us, such as special MOAA programs, offers, and benefits. If eligible, you may also receive free Basic MOAA Membership. You may express your preference to opt-out of receiving such promotional or offered membership communications at any time by following the unsubscribe instructions in a promotional email or by emailing msc@moaa.org. This opt-out will not apply to transactional, operational or informational emails related to your account and purchases. You may continue to receive promotional messages for a short period while we process your request. You may change your preferences to begin receiving types of communications again through our manage preferences links at the bottom of emails.

 

VI.  HOW WE PROTECT YOUR PERSONAL INFORMATION

While we endeavour to incorporate reasonable safeguards to help protect and secure your Personal Information such as transmitting information via industry standard secure server layer (SSL) and tokenized payment processing, no data transmission over the Internet, mobile networks, wireless transmission or electronic storage of information can be guaranteed to be 100% secure. Therefore, we cannot guarantee its absolute security. It may be possible for third parties to intercept or access transmissions or private communications unlawfully. Any such transmission is done at your own risk.

 

VII.  ABILITY TO ACCESS, UPDATE AND CORRECT PERSONAL INFORMATION

MOAA wants your Personal Information to be complete and accurate. You represent and warrant that all information you provide will be complete and accurate, and that you will update that information as necessary to maintain its completeness and accuracy. To confirm the completeness and accuracy of, or make changes to, your Personal Information, please contact us at msc@moaa.org or by changing the profile settings on your account.

 

VIII.  STATE PRIVACY RIGHTS

Depending on your jurisdiction of residence, you may have certain rights with respect to your Personal Information. This section describes your potential privacy rights and explains how to exercise them.

 

IX.  EXERCISING YOUR PRIVACY RIGHTS

Requests to know, correct, or delete can be submitted by calling our toll-free number +1 (800) 234-6622, or by contacting us at msc@moaa.org. You can opt-out of having your Personal Information shared with third parties for targeted marketing by adjusting the settings on your internet browser, by unsubscribing from commercial communications, or by managing your communications preferences. In most circumstances, you can enable and disable cookies from websites under Privacy and/or Security in the Settings function of your browser. Additionally, if your browser supports it, you can turn on the Global Privacy Control (GPC) to opt-out of the sharing of your Personal Information for targeted online advertising. You can learn more about the GPC and how to enable it in your browser from the Global Privacy Control website.

Please be aware that, unless otherwise noted, the rights specified in the “State Property Rights” section above currently apply only to Nebraska consumers. We will update this policy if we learn of their applicability in other jurisdictions. Only you or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information.

A.  Authorizing an Agent to Act on Your Behalf

When using an authorized agent, you must provide that person with written permission clearly describing their authority to make a request on your behalf. That agent must also be able to verify their identity with us and provide us with their authority to act on your behalf. An individual to whom you have provided Power of Attorney pursuant to applicable state rules may also make a request on your behalf. We may deny a request from an authorized agent if the agent does not provide us with the signed written permission demonstrating that they have been authorized to act on your behalf, among other justified reasons.

B.  Verifying Your Request

The verifiable consumer request initiated by you or your authorized agent must:

We cannot respond to your request or provide you with your Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. One of our representatives will contact you to verify your identity. You may need to provide additional information to verify your request. We will only use this Personal Information to verify the identity of the person or authorized representative making the request.

C.  Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. The response we provide will also explain the reasons we cannot comply with a request and provide instructions on how to appeal to the Attorney General as described above, if applicable.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

X.  CHANGES TO THIS POLICY

We reserve the right to modify this Policy at any time without notice. All changes are effective immediately upon posting. Your continued use of the Services after changes are posted constitutes your acknowledgement of the modified privacy policy and agreement to abide and be bound by that privacy policy. For reference, the effective date of this Policy is posted at the bottom of this page. Therefore, we encourage you to periodically check this page for changes made to this Policy or you can contact us at any time to obtain the latest copy of this Policy.
